They like to appear on the offensive when they are backed into a corner. It's a political trick with a lot psychology behind it. In this instance, it's so the people who are pissed at him have something besides "lock him up for life" as the answer. "Don't give him his money back" becomes another option. If he didn't sue, then "lock him up for life" is the only punishment option.

Can we use this somehow? Hastert is a known issue with a court record which isn't a "conspiracy theory". That could be an opening to inform regular people about how expansive the rabbit hole is.
