Here is something to consider: Is it possible that Comey KNOWS that Huma didn’t share these emails, because all of the blackberry phones are automatically synching? If you just hand out phones, you technically aren’t sending emails…you are just giving someone a phone, which happens to have the emails synched onto them. Donate some money to CGI, you get a special phone.

Was Weiner’s laptop a govt issued laptop, that would have the emails synched to it? There was an email in the wikileaks where they mentioned Weiner and his people (cant remember the verbiage) and were they reliable, or something like that. Was Weiner giving out the phones to people that donated money, so they could have access to certain sensitive emails, that appeared on their phones (but weren’t “sent”)?

This crap is SO bad, yet Huma and Hillary seem to not have any worries, and are out in public having a grand ol time. This story has so many plot twists that its upsetting.

There is intent - recklessness. Someone who drives drunk is consciously disregarding an unjustifiable risk that he will crash and injure someone. Someone who shoots a gun into the air is also disregarding the unjustifiable risk that someone will be injured, and if they die then they are liable. Clinton and Abedin can be inferred to have expert knowledge on the subject of classified information, so it follows that they knew that there was an unjustifiable risk their actions were the kind that were criminal. Comey is saying they didn't have even an inkling, because they were definitely negligent (where a reasonable person would have known there was a risk).

Trump was alive during the Watergate scandal when Nixon fired the IG and others resigned (called the Saturday Night Massacre). It's a politically delicate subject, and he's already done it once, when he fired the acting AG. Although she was openly defying him rather than resigning, so she was baiting the reaction and it was justified. Trump has to tread carefully to make sure that it doesn't backfire on him in popular distaste. I have a feeling Comey will get his, but it's a matter of timing.

Why is intention a necessary component for conviction upon committing these crimes? It is farfetched to believe that they didn't understand there was a risk. Comey is obfuscating the issue by excusing their behavior through a mistake of law defense, which is inappropriate. Comey is seemingly acting as investigator, prosecutor, and defense attorney. A jury would almost certainly find that Clinton and Abedin acted recklessly, and that ignorance of the law is no excuse. Their actions were too egregious; any reasonable person would have inferred the illegality of sharing top secret data. Because they were in the field, and presumably experts, they should be held to have known that sharing data was illegal. A plethora of expert witnesses could testify about why that would be the case.

There would be no expectation to be sent classified information on that system and it was not a document marked as classified, so why would a portion marking in the body of email be expected to relate to classification? In a classified document you have a classified header at the top of the document and every single paragraph is marked according its classification level.

They got a pass because they did not commit a crime. Every instance of mishandling of classified information is not automatically a crime.
