that is why I said both. I'm not sure what you are talking about with regards to lawful access if you aren't implying surveillance. There's nothing illegal about knowing about this phone call.

With regards to your questions, I'm not sure what specific questions you have about wiretaps or FISA.

Lawful access implies there something illegal about knowing about this call or it implies wiretaps or a bug or implying that the information is a secret in and of itself. It's not. It's not classified info and there's no laws against leaking it. There would be nothing illegal from Kelly leaking this to the press or his secretary or someone his secretary talked to going to the press.

There would be nothing illegal to having a secretary listen to the phone call on another line. There would be nothing illegal in Kelly taping the phone call. The law in DC is one party consent. That means you can consent to tapping your own conversation and you don't have to tell the other person.

Notice what Rohrabacher said...." said nobody in his office was responsible for disclosing the call." This means other people in his office DID not about the contents of the call.

Rohrabacher is not saying it was classified, he said

"I have honored the confidentially of a very important business-related call," he said, speculating that someone inside the White House or within U.S. intelligence agencies leaked the call."

It's fairly common for an executive to keep a call log and notes of the calls taken, this allows them to refer back them later. It's not uncommon that the executive is not the one creating these notes.

They didn't need FISA wiretaps or even unmasking. Everyone was unmasked that were classified as "enemies". I believe this is why Flynn went to the NSC - to find the secret SCIFs and their terminals and work backwards from there.

Understand there are SCIFs everywhere in DC. I mean everywhere. Given the flagrant violation of all security procedures by the last administration, there is no guarantee that the SCIF was ever certified by any cognizant authority.

As long as the proper terminal hardware was available to connect to the ghost ring via fiber, it could have been a regular terminal in a rented office anywhere and no one would ever now.

Until the data sluice is/was found, those programs could continue to monitor Americans illegally.

Not shutting it down but reforming and following constitutional law might help. The POTUS or NSC such as Kelly would only lawfully be intercepted by very few. Leaking it in any form is against the law. Narrowing down who did it would be easy. I am sure Admiral Rogers knows and is not pleased.

The risk to NS is huge if not only allies don't believe they can trust the calls but foes is horrible.
